The positioning does seem a little odd, but at least you no it was fair and random, if you're family had been in that position it would have been different for you guys perhaps, you can only deal with where you start 
36/09 do seem like the best fams and allied, they were probably bound to win, but I've seen some other fams with good attackers and I see much smaller fams with huge bankers, maybe contact some players and see if they'd be interested in giving 09/36 a run for their money next round 
And it seems like your leader was worried about 09/36 with that NAP so made concessions, in my opinion, you always fight before you NAP, you might just find that you gain a bit of respect/a bit of extra space that way. Just because you are smaller, doesn't mean you can't be a massive pain in the bum
