all officers of the Constitution under the "rank" of President and Vice President ( who are elected) have to be confirmed by the Senate (including generals and admirals)

if the Senate is in town and refuses to vote then the office is technically empty. (how crap gets down without a boss in the office, well I guess you Europeans understand that better than we do.  That whole "Yes Minister" thing)

Some functions though absolutely require a functioning set of officers.  Who have to be confirmed.

EXCEPT if the Senate is not in town and not holding sessions, then Presidents have an opportunity to set up an officer as somebody who couldn't be confirmed, so, he ought to be left in the office as a "Recess Appointment".

a competent president doesn't do that very often as it just works better when he has the Senate on board for his nominations. your average Senator combines stupidity, lechery, greed and pomposity, and they are better if they are made to feel important by doing favors.

Obama isn't very good at being president, though, so he decided that if the Senate was not as busy as he thought it should be, even if it said it was formally in session, then it wasn't in session.

The court disagreed and also, looking at the language, figured that the Senate is actually "in recess" only once every two years.  Just adjourning isn't a recess.  That's new.

I think the Supreme Court will agree with them, and then the Republicans will be in a panic, because Obama won't give a damn, and not giving a damn creates a crisis where Republicans may feel compelled to try and make him give a damn, and they won't get Democrat votes to succeed.  The Democrats don't mind creating an imperial presidency, because if they lose it, they will just riot to stop a Republican president from behaving like a king.  A Democrat king pleases them.

Rather than allow Obama to crown himself King, they will just make it legit by giving him what he wants.   As they've just done with raising taxes, and confirming his illegal amnesty waiver, and agreeing to "suspend" the debt limit.

its as if there wasn't a party platform, as if they didn't campaign against their current agenda and win.   Every Republican in the House defeated a Democrat who stood for higher taxes, more spending, amnesty for illegals, funding for abortion, defeat in war and gun control.   Somehow a Republican majority ends up meaning higher taxes, more spending, amnesty for illegals, funding for abortion, defeat in war, and gun control.

The only way to flush the Boehners, Bushes, Roves, Lotts and Cantors is to make them lose.  That's it.  We can destroy the Democrat establishment with a dedicated crew of politicians.   This crop of asshats couldn't run a pancake breakfast.

Boehner won cause the group seeking to unseat him was incompetant in the severe.

Well if the douche bags had thought to not bungle it so badly they could have gotten more support. As it is they F'ed it up so badly it was an embarrassment.

However I would still have not voted for Boehner. Damn the consequences from the Establishment but I would have thrown his ass out to the curb with a 'will vote for donuts' sign around his neck.
