cockroaches!
i think we should just have a maniacal tickle fight
I would seriously suggest the bar association then. You don't have as many barriers to bring a contract claim. You don't have a private remedy for them breaking the law as far as I know. You might be able to hurt them as Imperial suggests but it will not result in any remedy for you. I am not allowed to give legal advice but if I was you I would talk to the county bar association, state bar association, and ask for advice.
were you part of a collective bargaining agreement?
ahh ok i'm not familiar with that (really have no familiarity with labor law, only civil litigation for the most part). If he's part of a CBA then it will have its own SOL. If he is bringing a regular contract claim in state court then will depend on whatever state he lives in. I think most are around 3 years or 6 years depending what action it sounds in but don't quote me on that. Depends on what type of cause of action you bring against the employer. By the way is there a union involved and do you have to exhaust those remedies before turning to other causes of action?
for which claim? were you a part of collective bargaining agreement Einstein?
just don't miss the statute of limitations of the claim if you decide to bring it hehe
Eh, I don't deny that as labor law is something I do not know a lot about unfortunately. It can't hurt to inquire though as some lawyer may want to take up the case if he/she finds it interesting. If the lawyer takes on the case he/she will pay for any copies you need and it will come out of the judgment.
well you're plaintiff so if a lawyer decides you have a good case he will be doing it on contingency. if not, bar associations at least around here have many good lawyers who volunteer their services to clients that cannot afford to pay their rates. it looks good on their resume to say that they gave back to the community while on the other hand breaking up families and what not
you may also want to ask about a retaliatory discharge claim although i have no idea what your state's law is on the subject or any subject for that matter. usually at will employees can be fired for any reason or no reason at all but some states recognize a public policy exception for if you are fired for something that violates public policy such as obeying the law, not perjuring yourself etc. It would also be helpful to know if you were part of a collective bargaining agreement because then your claim would most likely be in federal court and much harder to prevail on. You can look up case law for your state on google scholar for free and try typing in searches for cases that sound similar to your situation. Other than that, the local bar association should be able to provide a list of lawyers who specialize in that area as said above.
I'd suggest scoping out the local bar association where you are and asking about who does that type of law and how long they have been practicing etc.
flint, my post was more (and this is my fault for not explaining) do you think affirmative action is a form of racism that still exists?
congrats ![]()
we could just build respective forts out of bedsheets and have a war with nerf weapons
wasnt that a line from face off?
ill give you something to work with, why is a point system illegal but it's ok to have a system where they still qualify it but don't count the points and it is ok
That's easy.
Do you think by random statistical chance there can be an employer with all blacks? All latinos? All asians? All native Americans? All caucasions?
Do you also think random chance says there can be employers with no whites? No latinos? No asians? No native Americans? No blacks? No space men from Alpha Centari?
What about a business having no men? No women? No gay men? No gay women? No trans-sexuals? No athiests? No Christians? No buddhists? No taoists? No Jews? No muslims? No Mormons? No left handed people? No artists? No criminally insane?
If you think random chance can create an employer somewhere in the United States without one of the above naturally and through no ill intent then how can you selectively say when a business should hire x group more?
Also how does this adress the other of hundreds of racist policies? How does this adress Democrats claiming racism where none exist so they can score points politically?
- what kind of lame google answer is that? I want precedent flint, i know you are better than that
should know that i have been banned from Narnia for burning Lucy at the stake after accusing her of being a witch
should know it's a business transaction if you pay for it and therefore can't be considered cheating. That only works for guys though since we all know girls don't like sex, with me at least, and only do it for emotional reasons
