Topic: i need a lawyer

My company clearly violated Department of Transportation rules. I can win this with so much ease.

But I do not know any lawyers specializing in trucking and DOT. Does anyone here know of a USA lawyer I can hire to win this for me?

I am the victim as they punished me for safe driving practices. DOT requires them to enforce good driving, not to punish it!

are you employee or contractor? I think you should talk to the dept of labor in the state where you work, or call the DOT.  You want your record cleared, right?

I'm not a lawyer but i'm well schooled in the CFR 49, and other CFR's within the DOT's regulatory rights, and laws pertaining to ---

I got punished for safe driving. That's what's up.

Weather issues back when were iced interstate for issue #1. 45 mph wind gusts. I nearly got blown off the off ramp. I stopped for safety. Issue 2, driving at night, trailer lights go out due to a severe electrical short. I have access to the part, the metal melted. I pulled over.

Issue 3 was again poor weather, it was a long lasting winter.


I was told by my fleet manager I was getting written up, I complained to his boss and demanded a new fleet manager and the write up to disappear. I got the fleet manager, the write up stayed.

Than DOT Isn't who you want to be speaking to, contact the Dept of Labor/OSHA -- Obviously if you have documented proof of your claim your company would be faced with 2 options, clear the write up, or be fined by OSHA for violating safe work practices.

I got certified for various DoT/Legal/IATA and international laws for the Marines, as one of my duties was deploying the unit to, and from Iraq - We do all our own commercial requests, and documentations in-house.  -- Or did since ive been out for 3 years haha.

I gave them a chance to clean it up, even well documented. They apparently never did.

Like i said the only real authority here is OSHA, as they handle this types of issues (Safe work practices), if you are being punished for being safe, and can prove that claim, let your company know of your intentions to contact OSHA should the written reprimand not be regressed from your personal file - Otherwise you will pursue action with OSHA, that might spark a serious issue with your job, just know how far you are willing to take this, as it's illegal for them to fire you for notifying OSHA, be sure that you won't get an invite to the companies picnic tongue

I'd suggest scoping out the local bar association where you are and asking about who does that type of law and how long they have been practicing etc.

you may also want to ask about a retaliatory discharge claim although i have no idea what your state's law is on the subject or any subject for that matter.   usually at will employees can be fired for any reason or no reason at all but some states recognize a public policy exception for if you are fired for something that violates public policy such as obeying the law, not perjuring yourself etc.  It would also be helpful to know if you were part of a collective bargaining agreement because then your claim would most likely be in federal court and much harder to prevail on.  You can look up case law for your state on google scholar for free and try typing in searches for cases that sound similar to your situation.  Other than that, the local bar association should be able to provide a list of lawyers who specialize in that area as said above.

They are firing you over this? Then you do need a lawyer, once that specialized in labor laws, make sure you file a complaint to the Dept. of Labor, OSHA, and the EEOC just for good measures, as the lawyers won't talk to you til you report it to the feds, i know that from experience.

well you're plaintiff so if a lawyer decides you have a good case he will be doing it on contingency.  if not, bar associations at least around here have many good lawyers who volunteer their services to clients that cannot afford to pay their rates.  it looks good on their resume to say that they gave back to the community while on the other hand breaking up families and what not

Yeah, but Pro Bono Lawyers typically don't accept labor disputes unless the case is open, and close -- meaning you do most of the leg work before they even sit down with you, you get copies of all documentation, report to the federal agencies, and give copies of the federal investigations, and any findings to the lawyer -- Labor lawyers are hard-core pricks, me thinks some of them get a grease palmed to turn down certain cases.

Yeah I started studying law for a little, on my own, til I discovered you sell your soul.... well that and the agent of the court, limitations, requirements, etc... I then decided to become a math scientist, lol
