Some thoughts.

*it's not mentioned in that LA Times story but the prosecutor has been quoted elsewhere as telling the judge that if DSK got to France "we would have no legal mechanism for getting him out of the country."
Basically France traded Roman Polanski for DSK.  Because of the Polanski horseshit every judge knows a Frenchman can't get extradited.

Hella bad luck there, leaving your phone in the room on the one day when the maid flips out and invents a tale of rape.

I thought he cooked up this story before he met with his lawyers because Reuters had it first, reporting on a French radio story.   Because I didn't think US lawyers would let a rape suspect tell that story on the day of his arrest.

In rape cases, it's not good to lose, but there's degrees of bad losing scenarios.

1.  Copping a plea.  You won't get suspended sentence for rape, but if you argue it was consensual and then turned angry, or somethng, and admit you did it, this is probably the least harsh penalty.
2.  Saying it was consensual when the jury doesn't believe you.  This costs you the credit you'd earn just admitting you were guilty of bad decisions.
3.   Admitting you went out and forced somebody to eat your willy.  Generally this is not treated lightly  like threatening the President, which earns 5 years max.
4.  Saying the bitch made the whole thing up.  Wow.  This is asking for the full penalty.  I mean, this is like every racist judge on the NY bench can say  "Whaddya mean "racist"? we gave the Frenchman 25 years, didn't we?"  Telling this tale and then getting convicted tells the judge, only are you a rapist, and not really sorry, but you thought the court was STUPID.

If they find his sperm anywhere on her he is DONE.  If she can accurately describe his penis he is DONE.  The only way it could be worse for him, is if President Obama asked NY to spare him.

for the first 500 years of the modern tradition there wasn't separation of those ideas.  The King's Justice shielded you, if the King's Justice wasn't handy you had the right to save yourself; if the King refused to render Justice then the nation had the chore of finding a new King (safely asserted only after the fact, ofc)

only after industrialized wars so bloody that it was obvious serving King and Country was not anything like "self-defense" and in fact totally separate of meaningful SELF interest, that we have the idea we a) don't have the King's Justice as a shield and b) can't allow states to react like individuals when it comes to defense.
