being too drunk to consent is a law here in south carolina (where im from)

Here it actually works this way... If the woman has any bit of alcohol in her, then the man will be charged with rape because the law forbids the MALE from have any kind of sexual contact with a woman who has alcohol in her. The man will still be charged with rape if both of them were intoxicated. Now I know you are wondering what happens if the male is intoxicated but the female is not... no one can be charged.
