Topic: Judicial Hilarity

Now of course, we all know judges are supposed to try to be unbiased...

But every so often (more often in years gone by), they seem to forget that point. Lord Denning was famous for this.

I was reading the Denning's dissent from Miller v. Jackson [1977]...and this passage made me chuckle, so I thought I'd share.




"In summer time, village cricket is the delight of everyone. Nearly every village has it own cricket field where the young men play and the old men watch. In the village of Lintz in County Durham they have their own ground where they have played these last 70 years. They tend it well. The wicket area is well rolled and mown. ... The village team plays there on Saturdays and Sundays ... Yet now after 70 years a judge of a High Court has ordered that they must not play there any more. He has issued an injunction to stop them. He has done it at the instance of a newcomer who is no lover of cricket. The newcomer has built, or has had built for him, a house on the edge of the cricket green which four years ago was a field where cattle grazed. The animals did not mind the cricket. But now this adjoining field has been turned into a housing estate. The newcomer bought one of the houses on the edge of the cricket ground. ... Now he complains that when a batsman hits a six, the ball has been known to land in his garden or near his house. His wife got so upset about it that they always go out at weekends. They say that this is intolerable. So they asked a judge to stop the cricket being played, and the judge, much against his will, has felt he must order the cricket to be stopped, with the consequence, I suppose, that the Lintz Cricket Club will disappear. The cricket ground will be turned to some other use. I expect for more houses or a factory. The young men will turn to other things instead of cricket. The whole village will be much the poorer. And all this because of a newcomer who has just bought a house next to the cricket ground"



(The injunction was not granted...though 2 of the 3 judges did find the defendants liable and awarded the homeowner 400 pounds....guess which one didn't tongue)

What the beep did you expect if you buy a house that's next to a freaking airport. You paid less for the house cause of it's location, you knew there was an airport there. You lost all whining rights.

Yeah we have that problem with California suburbs. If you point that out to them, they go kind of blank in the eyes and whine "But it sucks! If you would just fly somewhere else it wouldn't suck! Why won't you just do that? Its because you won't do that, there's a problem."

Judges are supposed to be unbiased, int he view of the masses. in reality, they're supposed to be biased. their job is to be biased. they look at the facts of the case, and then apply their personal bias, to determine outcomes. thats their job.

Judges are supposed to be biased only to one thing, the Constitution and the law of the land. Nothing else.

Judges who apply their own bias need to be shot before a firing squad.

Everything bad in the economy is now Obama's fault. Every job lost, all the debt, all the lost retirement funds. All Obama. Are you happy now? We all get to blame Obama!

if Judges were supposed to be unbiased, computers would of taken their jobs long ago. ever notice how the most successful judges are the ones with a bias either towards republicans or democrats? how do you unbiasedly interpret the constitution and laws of the land? you dont. every human uses their past experiences to judge things, judges are no different, and those past experiences are what bias is.

A computer cannot possibly go into a trial with hundreds of witnesses and tons of evidence and decide properly what should and should not be allowed by defense and prosecution, nor could it study without tons of input a wide variety of evidence types. It is not possible to work.

wow what he is saying makes sense absolutely. you just have a narrow mind einstein and u dont like it when someone says something contrary to what you have been taught.

A judges job is to interpret the constitution and you said this yourself. So when they INTERPRET the constitution they are applying some kind of bias to it and it is usually impossible to interpret the constitution without bias unless you were the one who wrote the constitution. Most cases are obvious looking at the evidence who is innocent and guilty but in some cases when they are truly required to interpret the constitution they apply a bias to it.

You know, the homeowner could have just erected a giant net, such as around a baseball field's home plate to limit the amount of "fly balls" knocking a fan in the head, or the nets surrounding golf courses that are next to populated areas and waterfronts. However, in the event that the cricket team did have to vacate the field, it's not as if they wouldn't have found another green to play in.

I do not want an anti-gun judge ruling on my self defense with a gun (if it should ever happen) with his bias included.

Nor would you want a judge giving you ten years for spraying a tag on a wall when he has a crusade against it.

what bias do you think they're applying if it isnt personal bias? what people want, isnt relevant, im saying how it is, Judges are biased, not that i want judges to be biased, or that its good that judges are biased, simply that judges are biased.

edit: also, im pretty sure i never said they apply their own personal bias, but that they apply bias, and you have already admitted that, they do apply bias; so my point is made, and the lone opponent has conceded the point.
