A Texas teenager who has been in jail since March faces an eight-year prison sentence because of a threatening joke he made while playing an online video game.

In February, Justin Carter was playing “League of Legends” — an online, multiplayer fantasy game — when another player wrote a comment calling him insane. Carter’s response, which he now deeply regrets, was intended as joke.

“He replied ‘Oh yeah, I’m real messed up in the head, I’m going to go shoot up a school full of kids and eat their still, beating hearts,’ and the next two lines were lol and jk,” said Jack Carter, Justin’s father, in a statement to a local news channel.

The statements “lol” and “jk” — meaning “laughing out loud” and “just kidding” — indicate that Justin’s statement was entirely sarcastic, said his father.

But a Canadian woman who saw the post looked up Carter’s Austin address, determined that it was near an elementary school, and called the police. Carter was arrested one month later, and has been in jail ever since. He recently celebrated his 19th birthday behind bars.

Authorities charged him with making a terrorist threat. If convicted, he will face eight years in prison.

“These people are serious. They really want my son to go away to jail for a sarcastic comment that he made,” said the elder Carter.

Authorities noted that recent school shootings like the one in Newtown, Connecticut have caused them to evaluate all potential threats seriously. Newtown was still fresh in their minds at the time of Carter’s arrest.

“In light of recent situations, statements such as the one Justin made are taken seriously,” said an Austin police detective in a statement.

Carter’s father said his son didn’t follow the news at all.

“Justin was the kind of kid who didn’t read the newspaper,” said Jack Carter. “He didn’t watch television. He wasn’t aware of current events. These kids, they don’t realize what they’re doing. They don’t understand the implications. They don’t understand.”

Carter’s parents have launched a change.org petition to convince Texas Attorney General Greg Abbot to release their son.

“Release Justin Carter from jail,” the petition reads. “Too many teenagers are being arrested, jailed and having their lives forever altered because of anti-terrorism laws and investigations that impede their 1st Amendment right to freedom of speech.”

A hearing to review Carter’s case is scheduled for July 1.

I'm sure he's learned his lesson. Words are powerful. History has taught that. They will drop charges in agreement to do 500 hours community service and not put the charges on his record.

I'm taking this one with a big fat grain of salt.  The reporter doesn't quote any prosecutorial source.  There's no explanation why his folks didn't seek bail for their son.  Even if I thought the US Attorney was a nut who wanted to throw the book at him that doesn't explain why the judge feels locking him up is a good idea.  For all I know he has an altar to Satan in his room and they found a recipe for raw hearts on his computer.

this is not serious, the soziety under paranoia, taken a zhat stuff seriously from an online videogame instead of looking for the real villians (yes those in white suits in their offizes at the whitehouse, penthagon etz...).   Dont know in waht part of the prozess they missed to realise the video"GAME" part, a game that, akkording to your paranoik law kan put your bones in jail

It's his fault for not reading/watching the news. Was he not aware of the vague and obscure anti-terrorism laws? He was 18 after all. If he was counting on US constitutional provisions for "Freedom of Speech" then he didn't get the sodomy booklet in the mail.  He should know that you mustn't say anything that would offend someone, because all it takes is for one Nancy to to point the finger and yell "terrorist!" -- even if he was attempting to be darkly sarcastic.  Context: we used to have higher attention spans to consider it.

i am skeptical as to the truth of this as well.  it seems odd he wouldnt be eligible for bail.  if he was going to be treated like a terrorist then he wouldnt get due process at all so talking about being formally charged and put on trial is odd.  i'm assuming it's his first offense and it's not a murder in the first charge so shouldnt really be ineligible for bail.  i doubt he has a substantial criminal record. i also doubt he is extremely well off to be considered a flight risk because if he was then this bs charge would have been thrown out immediately by a halfway decent attorney.

then again i dont practice criminal law and this is texas which is happy about executing its first female criminal so who knows.

I just want to note that Texas has a population of 26 million people.  Not that its population is more than Canada's, but you're not exactly talking about Delaware here.  Cutting up the military size by dividing it on a state-by-state basis would generally work, but not when you're dealing with... I think the 4th largest state in the country.

I meant rifles per capita.  I saw / heard it somewhere Canada had more rifles per capita than the US.  Can't remember where.

Grisly new details emerged in the story of the ongoing imprisonment of Justin Carter, who racked up months in jail for making sarcastic, violent threats after playing an online video game.

Carter has been beaten up multiple times while in jail in Comal County, Texas, according to NPR. He is now on suicide watch.

“This was his first incarceration, his first charge, and without getting into the really nasty details, he has had concussions, he has had black eyes,” said Jack Carter, Justin’s father, in a statement.

Carter also said his son has become depressed about his situation, has spent time in solitary confinement and has been moved out of fear that he might hurt himself.

Justin Carter was arrested last February for making a sarcastic, threatening remark against a school after being provoked by another player in League of Legends, an online video game. Carter followed his remark with “lol” and “jk,” signalling that it was not a serious threat. Nevertheless, Texas authorities have charged him with making threats of a terrorist nature, and set his bail at $500,000.

Carter’s lawyer, Don Flanary, was shocked by the high bail amount.

“I’ve represented murderers terrorists, rapists, anything you can think of,” said Flanary in a statement. “I’ve never seen a bond at $500,000.”

A spokesperson for Comal County told The Daily Caller News Foundation that Carter’s bail was set by a judge, but couldn’t say why the amount was so high. A large bail typically indicates that the suspect is extremely dangerous, or a substantial flight risk.

Carter is one of two teenagers imprisoned for months for the crime of making off-color, threatening comments over the internet in response to a video game. Josh Pillault has been imprisoned for even longer–since last October. He recently pled guilty to the charges against him out of fear that fighting them would result in a lengthier sentence.

“This has been an absolute nightmare,” said Stacey Pillault, Josh’s mother, in an email to TheDC News Foundation.

I have driven in Canada a lot, and in Texas a lot.

The Canadians could hold up in the Rockies and hide forever, but the Texans would own everything from Calgary to Quebec with ease. Seriously the Canadians are so pathetic it is sad... Safety vests inside a truck yard with a speed limit of 5km/h! A fully lit up truck yard at that!!!!
