Like I said, it's a political noose, that would destroy any politicians standing. The reason for that, because it treads on the rules of self governance of each state, as stated in the amendments.
There are a lot of "Laws", which are written which can either strengthen or delute the power of amendments and statutes, depending on...well...whoever sits on the supreme court. It's a ballet. It's a dance. It's a fiasco waiting to hit the fan. Never said it forabde militia's. Just has certain limits on how big the militia is allowed to be, when formed. But there's very few states that use active militia's. There's a few "private militia's" which receive anonymous donations, which are not so anonymous as certain Alabama state governors would like to think. Now if it was a state militia, why would Alabama pay through second and third party's to equip said militia, if it wasn't an above board militia.
Because the state, by federal law, can only raise a militia to only have a limited body of men and/or women. This was to deter the states from succeeding and carrying out attack with personalized state armies.
You know this whole militia mess has been around since the Civil War. And each time the Federal government has curtailed some element of the militia's, certain states, in fact only a small number of states have a live acting militia. The rest of the Federal states of the United States of America, fully rely on the all volunteer force of the National Guard.
The National Guard, follows the chain of command as issued by the Joint Chiefs of Staff, and the President of the United States.
Private state Militia's, do not. Hence rules and regulations and laws which prohibit unilateral unlimited size and growth of individual state SPONSORED militia's. There's over a hundred militia's nation wide, which are not "officially" state sponsored, but are "privately" funded. If you want to take a time out for a week, a month, or even a year, to follow the money, you may do so. And you'd be very suprised why those funds aren't above board, and legally channeled by the State Treasuries.
