Europe just died with that ruling... financial cliff is no longer an apt term... financial blackhole is more appropriate.

yeah its 2 year old decision I found about today

apparently they do have a "legal privilege" for outside lawyers, just not in-house counsel.  Not independent enough.

The problem is going to be what standard things like WTO go for, because if the EU sues USA for what US corporation does they will probably argue they can have everything Boeing and Eli Lilly in-house counsel did. 

I suggest all NGOs follow American law or we kill them with drones.

And yes its ridiculous to think corporations won't flock to Europe, just look at their economy over the last 2 years.   Oh wait.

Militia's were either disbanded, or in the 200 years hence...were folded into what is called the National Guard or Reserve Forces.

tongue thpppppt.  Most militia's are PRIVATE organizations.  Only two states of the union directly funnel money to state militia's.  And they both believe that the south will rise again.  Which is why both state militia's are under constant survielance by the FBI, CIA, Tobaco and Firearms, lets just face it, every federal agency is keeping a close eye on ANY and ALL militia's within the United States.  Mostly because they can not be vetted or trusted by the federal government.

I wouldn't trust them.  Bunch of redneck god fearing hillbilly racists?  I wouldn't trust them as far as I can spit.

good lesson on the "living constitution"

Militia were a state power since the beginning.  State Militia "augmented" federal forces and were 2/3 of US forces in every war up to Spanish War.  By the time of the invasion of Cuba, magazine-loading rifles meant that nobody was making cartridges on the spot like at Bunker Hill...they had to have factory made ammo in the right size, at hand, immediately.  Since every state used a different rifle it meant NY Militia had to use NY ammo and CA militia hand to use CA ammo and neither could use federal US Army ammo.  No problem, just make sure the boxcars stayed with the passenger freight, right?

The invasion force at Tampico was supplied by a 1 track rail line.  Nobody got their own bags.

After this fiasco the Dick Act of 1906 offered states federal arsenals and armories and uniforms in exchange for federalized training of militias into fully-compatible forces.  This was reinforced by the National Defense Acts of 1917 and 1947 which gave them the same ranks and jobs as the federal military, and assigned state units set tasks within the federal military.

All this means, some 100 years later, you imagine that state militias are over.

But the practice of 100 years of -statute- cannot erase the Constitution.  Every state governor can raise a militia independent of the Feds.

You forgot the Military Incorporation Act.  And it's a tiny little federal law.  But it's on the books.  Mostly collecting dust.

In times of crisis, the federal government can fold a militia unit into the Federal Armed Forces.  They've never really used it, but it's there.  The government has never used it, mostly because it's a political noose, that ends most politicians careers if they ever tried it.

Actually no, there is a federal limit to how many able bodied men, and units a state is allowed to raise under the old militia laws.  And the federal government, the States, and the NRA have battling about it ever since.  There is a set limit to the available bodies a state is allowed, under federal laws to raise.

Do you actually believe that the federal government after the Civil War would just allow individual states to raise their own armies, possibly to attack the federal government?  I don't think so.

Where's the "federal limit"?  Never heard of it.  State militias were raised for the Indian Wars, and the Spanish war, and even after the Dick Act for riots and such.  the "national guard" was created in the National Defense Act of 1916

The National Guard was the "Legal" version of militia's under state authority.  Though officially the National Guard answers to the chain of command, and not the state governor.  The state Governor can "request" assistance from the National Guard in times of crisis.

God i'd have to find the fricken JAG log books on militia's and dust them off.  But yah, there's a limit.  I think it was originally problematic, because it states you can raise only so many Units.  But the number of abled bodied men in each unit was different from state to state.  Like a Battalion of men from Arkansas, was a 100 strong, where as a Battalion from Maine was 150 strong.   But each state was only allowed to raise so many Units, which held only so many men.  I can't remember what the "set federal limit" was for militia units.

But it was set, to keep private state armies in check.  Anything larger than that limit, they were usually ordered to either disband, or let go the extra troops.  That's why some states still have Active Militia's and "Militia Reserves."  Now you and I both know about Militia Reserves.
