Nobody ever mentioned government advising anything. Buying into anything. We're talking about government babysitter mandates and restrictions.

Taxing it additionally, claiming it's to cover healthcare, is problematic because of this little thing called the United States Constitution, the fourteenth amendment and other places.

I don't suggest taxing soda additionally. I merely say that its not irreconcilable to tax soda. And I don't advocate taxing unhealthy things to pay for healthcare.

In principle I probably agree with you - but you cannot base an argument on man-made premises without drawing it to a logical conclusion. Therefore the constitution doesn't make something irrefutably wrong or right.

Let me tell you about a taxation model the American founders would have found familiar. Government raises its income from taxes on luxury items, there's no income taxes, and most public services are public in the truest sense - paid for by the public who wishes to use them. That was the UK - a nation whose principles were dented by wars.

Of course soda would not logically fall within the luxury bracket - since it is cheap and universally enjoyed. But it wouldn't be indefensible to tax branded soda.

The Yell. OK if you're thirsty and having headaches then maybe you left it too late. But there's lots of signs you can use. My argument was against Flint saying he 'needs' a large soda to get through a film. Not that there's no circumstances people may need to consume a lot of water - in some form.

The 9th Amendment sounds interesting. But again I doubt there's a right to photon torpedoes or soda implied, as the absence of either doesn't deny general liberty. As I understand it, no part of the US constitution can be expunged and you have to live with the flaws for eternity?

Um technically it's all there, we just amend by codicil.  But we've rendered parts of the Articles void (direct election of Senators, and the Presidential succession) and then we even cancelled out an Amendment (prohibition repealed by another amendment)

that's the good old days I'm afraid.  In 1970s Congress passed a civil rights act guaranteeing the vote to 18 year olds in every state, and I think it was Montana that sued in the Supreme Court saying Congress can't pass laws telling states what to do, because states set up federal elections.  Supreme Court agreed that an amendment would be necessary if that's what America wanted.  Within 6 months both House and Senate passed and 3/5 of states ratified an amendment to give 18 year olds the vote in every state.

Now they'd just sue arguing that the 14th Amendment passed in 1867 guaranteed due process, so, of course 18 year olds got the vote, only nobody figured it out, and opposing the idea is bigotry and discrimination...

As I have already explained, nobody was talking about government "advising" anything. What you said about that made no sense. Nobody was talking about "buy[ing] into" government nombers. The Mayor of NYC is proposing that soda of 24oz size be banned from sale in the city. He's not advising anything. We're not discussing "buying into" government suggestions. It's not a complicated topic. If it's too complicated for you to grasp, yeah, I'm going to presume you're trolling. tongue

Americans don't have the right to "general liberty," they have a right to liberty. This includes photon torpedoes. Once (ONCE) I bought a super soda from Jack in the Box on a hot day and drained all the soda out before I got back to the office.  I got a 12 oz can of soda from the office fridge and poured it onto the ice in the cup.

It filled it.

Soda vendors buy proprietary syrup from Pepsico or Coke.  Then they blend it to their ratio of soda water of their choice, and offer you lots of ice.  They haf vays of making up the cost of the soda before it gets to you.  You're gonna pay $x for a soda-sale, so, they can make nickels out fo that by serving you less soda, weaker soda, and icier soda.

Fro Yo, it's just fro yo.  It has to be left alone.  You serve yourself and lets face it you don't take a knife and level off the cup when you do that.  If they could cut the fro yo with milk and put it on ice for you, yeah it'd be priced like a soda

Their are laws against the governments control on commerce.  As a citizen I am allowed to purchase any legal substance I wish and purchase it in any quantity I wish.  The government is overstepping its power by telling businesses what quanties they can and cannot sell. 

Although I think this ban is unlawful, I think the citizens from NY need to fix this problem... their mayor has just come up and said that every one in NY is too stupid to know how to drink properly and its only through government control you morons will be able to live.  Is there any reason this guy is still in office?

Two other notes.  Some people are saying this ban is too keep people healthy - this is wrong.  They are not banning how much you can buy, they are banning buying in bulk.  Two 12oz pops costs about 50% more than 1 24oz pop.  This is another way to collect more taxes without raising taxes. 

Secondly... Flint or any IC player at a theater with a girl... LOL!   Like that would ever happen tongue

It's no secret that sodas are very profitable. I've seen soda profits estimated at 80-90% of the price. Are you saying that bigger cup sizes give the establishments ways to make more out of the soda? Most of the time the sodas are self-serve. You decide how much ice goes in and are free to refill. Sure, you have no control in a drive thru, but you don't have to use drive thru do you? Frozen yogurt have toppings that one can add, some are more expensive (ie. 'fresh' fruit) and some are less expensive. In the end, you are charged by the total weight regardless of the contents.
