meh, doesnt matter if she caused the accident unless she was reckless or it was intentional most likely (if their workers' comp system is similar to ma's that is).  in a lot of systems the person is still entitled to workers' comp even if their negligence causes the accident as long as it was in the course of their employment.

comp was introduced to have a sort no fault system of benefits for injured workers.  you have a much less burden to prove entitlement to comp than a civil case for personal injuries but the trade off is that you don't get punitive damages and pain and suffering etc.  you just get compensated for your a percent of the loss of earning power based on the wages you were making at that time.  of course that is the system in massachusetts and i believe that is the norm for most states. some states (like CT) i believe you just get a flat sum which is awarded based on the amount of loss of function or scarring or impairment of certain body parts that are listed in the statute
