sounds about right. if you conceal something from your partner that would keep them from marrying you and they find out about it after they marry you, they should be able to annul the wedding.

I expect this decision to be reversed in appeal.

The article on which they base themselves to annul the marriage states that when you 'err' in a person, the marriage is void. But the explanation-interpretation of this article is that to 'err' means you've married someone with a mistaken identity, e.g. carrying a false name, or a twin. Consequently, since it is rather far-fetched that this would ever happen, in Belgium (with the same code and on the whole the same interpretation) no-one has ever used that article yet. Consequently, the decision will probably be reversed.

I agree that this decision should be quashed, but this is typical multicultural reasoning and it's possible it ends up on the desk of people with a similar mindset as the first judge clearly had

you need to understand the legal intricacies; now I'm not an expert in franch marital law but generally speaking:

annulments = the marriage never existed, meaning everything contracting parties got from eachtother has at least in theory be restituted; since this looks to be a conservative muslim it means his wife stayed at home and didn't make any money, ergo she will have been the most profiting party from the marriage and will be in debt ; as opposed to a normal divorce where the wife, who is probably the weakest party, could qualify for some form of alimony from the husband;

there is a world of difference between the two so I wouldn't dismiss this case so callously, especially not if you're an obama supporter (lol)
