that's appellate court, in USA a trial court is decider of fact and can resolve the he-say-she-say-bullshit on one side or the other, and its binding as fact on appeal

lower court judge or a jury has substantial deference as to factfinding and credibility issues and will only be overturned if arbitrary capricious etc.. Schiavo died cuz her husband was a douche and had a new girlfriend but also because you can't pass new legislation to repeal the court decision you don't agree with haha
