In the US we have freedom of religion. If a legitimate religion preaches God given rights, then the state must recognize them or they infringe on freedom of religion. So We have god given rights and there is no need to empirically prove God exists or that God gave us the rights; a legitimate religion recognizing them is all thats needed to make them officially exist.
