1) the 35% NW is to RESTRICT higher nw from attacking lower nw. so that means if a lower nw attacks a higher nw unexpectedly thats not abusing their 35% nw restriction?

lemme correct you, 53 haven't been under 35% in at least one real life week. 47 just failed to clear because they didn't feel like 53 was a threat, it's a mistake on their part, not abusing the rulebook.
