meh, doesnt matter if she caused the accident unless she was reckless or it was intentional most likely (if their workers' comp system is similar to ma's that is).  in a lot of systems the person is still entitled to workers' comp even if their negligence causes the accident as long as it was in the course of their employment.

comp was introduced to have a sort no fault system of benefits for injured workers.  you have a much less burden to prove entitlement to comp than a civil case for personal injuries but the trade off is that you don't get punitive damages and pain and suffering etc.  you just get compensated for your a percent of the loss of earning power based on the wages you were making at that time.  of course that is the system in massachusetts and i believe that is the norm for most states. some states (like CT) i believe you just get a flat sum which is awarded based on the amount of loss of function or scarring or impairment of certain body parts that are listed in the statute

id support higher wages for teachers if they got rid of tenure, based the raises on merit instead of length of time there and they had to take out malpractice insurance at astronomical rates like doctors and lawyers these days and be held accountable for negligent teaching.  a lot of medical professionals, or at least solo practitioners, are not making as much money as you might think when you look into how much loans they have to pay back and how much malpractice insurance costs they have to pay to keep their business running because assholes like me sue them all the time.

there is little to no accountability for state, government, union and public employees in general in the united states which means the only motivation to work hard is each individual's work ethic which obviously varies a great deal from person to person.  i've worked in state jobs and private sector jobs and have seen a significant difference in how much effort employees in both sectors put in.  for instance, when i worked at a state court one of the highest paid employees in the clerk's office, probably making about 80-100k, only looked for items on ebay all day except for 5 minutes at the end of the day when she had to sign off on some things.

less accountability and motive to excel should absolutely result in lower wages.  unfortunately, that is not how it works these days and anyone that is not in a state/union/public job can look up on their state government's site to see the wages of various public employees to confirm that.

Also, most new lawyers (unless hired by mommy or daddy's law firm) either make very little or no money right now depending if they get hired and depending where they live ha ha.  there are way too many new lawyers right now and as a result they are in low demand.

are you talking about college or k-12?

what i said was indeed a very general statement which i only met to apply to suburban public k-12 grade teachers who have tenure.  it was also only based on my own experience.  for instance, there was a 6th grade history teacher who would write notes on the board at the beginning of the day and have the students copy them when they got to class and they could sit quietly or work on other stuff for the rest of the class.  there was little to no instruction.  of course, there are good and bad teachers just like there are good and bad employees in every field but my own experiences have led me to believe that tenure and teacher unions for public school k-12 teachers are dangerous things for our youth.

to contrast, we had a christian private high school where tuition was about 6k a year (this is 12 years or so ago) and the teachers were mostly brothers who made nothing near public teachers nor did they get the same benefits.  their students typically went on to much better schools than the students from my public high school.  the wealth of the respective students did not vary a great deal because the town i lived in was a very affluent area.  thus, my own personal observations have led me to believe that tenure and strong unions for public school k-12 teachers tend to encourage laziness

also, i'm probably biased because our teacher union went on strike every year and had to be imprisoned one year for violating a court order to return to work.  their repetitive greed (except for the teachers who got so sick of the union that they just left for another district) has probably influenced me a great deal on this issue haha

i can maybe believe above 40 hours a week for teachers teaching their first year of classes when making up lesson plans etc.  however, after that first year i sincerely doubt they spend much more time than 40 hours a week for grades k-12 unless you can tell me how often math theorems or grammatical etc rules change.  teacher unions are among the strongest unions in the country.  for part-time half year workers they make more than enough money and benefits than they deserve for their BA or BS degrees which any idiot who drinks 100 beers a week in college can graduate with.  they also have tenure which means they can stop working altogether after that is granted with the exception of possibly getting fired for rape charges.

the only k-12 teachers i think are underpaid are the inner city teachers who actually have to deal with gun violence and severely underprivileged or challenged kids.  look up the difference between what they are paid for the crap they have to deal with and the suburban teachers in well off areas like middletown, nj who i am referring to in the above paragraph.  it's a shame.

as for the part about phd teachers, those teachers are usually reimbursed for continuing education and they make a higher salary for the advanced degree.  there are not many public k-12 teachers (relatively) with advanced degrees.

haha fair enough.  i still need to visit their brewery in boston since it's only about an hour away from where i live

i only ever had fosters once and it was because it was at a bar at a wedding reception and a 24 ounce can was the same price as a 12 ounce bottle of any other beer and they only took cash.  it wasn't that bad actually but i wouldn't drink it on a regular basis

and the only good sam adams seasonal is their octoberfest!!!!  i love their regular boston lager and their black lager as well even though they keep rejecting my applications to work for their legal team in  boston.  they probably heard about me and are afraid ill take advantage of their free beer for employees deal

this is kind of reminds me of a Law and Order episode when the chick was the DA (district attorney) and she held that the death penalty would be on the table even though she strongly disagreed with the death penalty because the public demanded it.

i would be interested to know the amount of african american and hispanic legal voters in the county and when the next DA election is

i saw this on another site i think arby posted in chat and believe it said they could bite through steel toed boots. if the contest was sponsored by miller lite or a better beer company and the gift certificates were for beer then i'd consider getting a group of friends together and try our luck.   however, the certificate for the bass shop doesn't do me any good

i believe Florida has a "stand your ground" law which would allow you to use deadly force (ie gun, knife other weapons) even if you are not faced with deadly force (i.e. fists)  ((of course what constitutes deadly force varies but that is typically the generic norm)) if you feel your life is in danger of death or substantial/grave harm.  If the case even passes summary judgment and makes it to a jury then I believe he won't be convicted of anything or at most maybe negligent homicide.  I don't think he will get anything however because as Kemp says there isn't much evidence that we know about which would allow the prosecution to meet their "beyond a reasonable doubt" burden of proof.

this isn't to say that the family might not be successful in a civil court for assault, batter, negligence, wrongful death etc since the burden is much less there than it is in criminal court (i.e. the OJ simpson cases)



Edit- I'm too lazy to look it up just the same as I'm too lazy to edit this post for grammar/spelling mistakes that are probably there but I thought I read a subtitle at the gym on fox news that the feds took this case up or pressed some sort of charges?  If so, i'm not really sure what the charges are because it's a state matter unless he violated some federal gun charge etc.  Does anyone not lazy or drinking beer know about this?
