I say its unconstitutional because Congress to tackle national health care because the States are doing that--10th Amendment.
And even if there could be national health care it is unconstititonal for the Govt to mandate state to state insurance commerce and what each state-bound insurer must carry, but ban interstate commerce in insurance. 10th Amendment.
And even if that were constitutional its unconstitutional to order every American to participate. All other economic regulation is upheld on the theory that it is optional, and temporary; that a Congress can be elected that will stop it; and until that Congress is changed, the citizen complaining can achieve perfect liberty by choosing some other form of economic activity instead of farming wheat or meat or timber or radio or pharmaceuticals or aviation. Here, we have no choice. Ya breathe, ya gotta buy insurance. Violation of the 9th Amendment.
And even if that were constitutional it is unconstitutional to declare that we're subject to tax fines if we disobey, because that is unusual punishment (8th Amendment) given by bureacrats without trial, in violation of due process (5th Amendment) and waived for low-income people, so it's applied unequally in violation of the 14th Amendment guarantee of equal protection under the law.
The "general welfare" of the American people is secured by well-funded health care; but rather than engage in trampling state and individual rights guaranteed by the Constitution for an unprecedented, unconstitutional, unfair, unAmerican scheme for total conscription into private insurance, the Congress can achieve the same purpose through higher taxes, which are totally constitutional.

The system we have now isnt working. Statistics prove that. Is the new Health care bill good? Prolly not. But its a step in the right direction. Somethiing needs to be done. We are supposedly the best country in the world yet we have one the most f'd up health care system in the world. CEOs of insurance companys are the only ones benefiting from our current system.<<
BS. If you broke your arm you can go into any emergency room and get it fixed. If you have insurance, great. If you pay cash, great. If you have no money, great. It gets fixed.
I posted in another thread how a guy wtih a S for an arm can't get it fixed in the UK, they cancelled his last two appointments because he smokes. A smoker can't have his arm broken and splinted successfully, you see. I posted pics of WWII soldiers getting patched up WHILE smoking, but who am I to cite facts to bureaucrats.

I think it really naive to imagine "violence isn't how we do things in America" the record is clearly different. Now we have Congress presuming to order us to consume a regulated product, for the first time, while it's clearly going to fail to provide quality service. And Pelosi says that's a great way to do other reforms. That's unconstitutional, its forbidden to them, and if we have some violence to overthrow that regime, that is a good thing and better than their tyranny.
