In the Australian appellate case of Re Kevin (2001) the High Court agreed that psychological factors were just as important as physiological characteristics when determining and defining man and woman.

Though they didnt go far enough to place a definition, they criticised the trial court for trying to place a legal definition on the term.

This was a case where a woman who underwent a sex change tried to marry another woman. Under Australian law, only a 'man' can marry a 'woman'. They were trying to determine whether this 'transman' could be a man.
